Canadian in US on TN Visa

Post by Murph44 »

I went to the US to work a temp job on a TN on May 21. That job ended on August 25 and I then returned to Canada. I got another job in the US on a separate TN and entered on Oct 9. I have been in the States - minus a two week trip back to Canada - living and working ever since. I do not meet the Substantial Presence Test and am considered a non-resident alien.

Do I have to file as a non-resident alien in the US and then file as a resident of Canada claiming my US income? Also, what Tax Treaties can I use so I don't get double taxed?

This is all very new to me and any help would be great. Thanks.

You are resident in Canada until October.
Please see many first-year tax situations amongst the threads in this forum. There is nothing unusual about your case. A specific question later on when you are finishing your taxes might be answered.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
