Maternity Benefits (for Non Resident)

Hello,

My wife and I left Canada 4 years ago and moved to the US. We both Canadian citizens and now have green cards.

Last year my wife took a job in Canada and filed her taxes as a non-resident in Canada, as we kept our primary residence in the US where I continue to work.

Now my wife is 6 months pregnant and looking to stop working, we are wondering if she is entitled to Maternity benefits from her Cdn employeer and the Cdn government.

mat benefits frm her employer are best answered by her HR and their policies.

She would be entitled to the sae mat benefits from Service canada as if she had been living in canada, based on how long she worked, etc.

The benefits will be subject to flat Cdn tax as well as be in your US tax return.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

My wife is considering having the baby in Canada, being close to facility, etc.

What are the potential tax implications

Well, consider that unless she moves to Canada, she is not eligible for provincial healthcare; so she might want to move to Canada, making her (and possibly you, taxable there on world income). You will need to look into how YOUR health benefits cover her (any coverage she has at her job would only pay above what province pays -- which is nothing).

The child will be covered immediately by province, but will not be a US citizen, if that interests you. So there will be immigration process for your child to get their Green card.

Personally, I would be having the child near my home.
