canadian citizen on TN working in US

Post by vancouverite »

This is the first tax return I'm doing by myself so please bare with me.

I moved to the states for my job in feb 2009 and am still here so I will be filing as resident alien according the SPT? Since my situation is straight forward (no investments, 401K, mortgage etc) I will file using the 1040EZ ? My confusion is with my canadian return. How much of my ~$43K income can be put on line 256 under the tax treaty, is there a max? And is this coming from line 1 or line 5 of the W2. If there is a maximum and I exceed it, do I proceed to claim federal and provincial foreign tax credit ?

Thanks for your help in advance!

You have left canada. You should be filing a departure return, following the instructions in the Emigrants guide from CRA. You will rpeort NO US income at all.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

I guess since my ties with canada are weak (no spouse, don't own home, only have bank account and rrsp), I am a deemed non-resident and do the departure return ?

Thanks !
