Resident of the US for Tax Purposes?

Resident of the US for Tax Purposes?

Hello. I recently moved to the US from Canada on a K1 Visa, and when I contacted the Canadian Revenue Agency to change my address they asked if I was a resident of the US for tax purposes. I have not yet received my Adjustment of Status or my Employment Authorization, so would the answer to this question be "no"? If this is the case and I answer "no", when do I change my answer to "yes" - upon receipt of the Emplyment Authorization or Permanent Residency?

wered incorrectly. The moment you MOVED from canada to US (presumably you have no home in Canada anymore) you became a US resident and a Cdn non-resident for tax purposes. You live lagally in US and don't have Cdn ties to make you resident in Canada.

The answer you gave would be for a snowbird, perhaps, you is in the US for extended time and wishes his tax mail forwarded to US, but who remains a Cdn resident, with a Cdn home address, or leave a family behind whish he will continue to support while 'on the road' in US.

The answer you gave is of little consequence however, as you will indicate your deperture date on your deprating resident return in the spring.
