Residence status questions

Post by Xarr »

In May 2016, I will be relocating from Canada to Massachusetts on a L1 visa (canadian citizen). My spouse and child will stay in Canada until school end in June 2017. They will then sell the house and move. Until then, I will be the one visiting them in Canada every month or so and them only visiting me on long holidays.

1- Will my departure date be May 2016 or June 2017?
2- Will Canada consider me a resident until June 2017?
2- What residence status will I have in the US?

I read many past posts but still unsure of my situation.

Thank you for the help.

You will be resident until 2017.You can file in US either non-resident by treaty, or file a full 1040. There is a special 1040NR for married residents of Canada.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
