Canadian working in the USA - US and Canada Tax Questions

Post by matthew12 »

Hi Everyone,

I am a Canadian citizen who worked for an American company in the U.S. on a J1 Visa from August-December 2015. I have determined I am a non-resident alien because I fail the substantial presence test for 2015. I have a few questions about my US and Canadian returns.

1. Am I able to claim exemption for paying US taxes and just pay taxes in Canada under the Canada-US tax treaty? I made over 10k and worked for a US company so I am thinking no?

2. Do I need to file form 8843?

3. Do I need to file any form other than 1040NR EZ and my state 1040?

4. Can I claim the standard deduction (6300$) or is this only for residents?

5. Can I claim the standard personal exemption of $4000?

6. Can I claim all the US taxes I paid as federal foreign tax credits on my Canadian return?

Thank you for your help!

You report your J1 income on a 1040NR, and determine the tax. You cannot exempt your J1 income.
Follow the rules on 1040NR, which would include 8843.

Then use the tax you calculate on 1040NR as your US tax on your CDn return.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
