Seems like Vermont has come to a complete stop - currently, they're quoting July '06 as "latest processing date"

I am royally screwed this time - my GC priority date is current (after 4 years), but my immigration lawyer doesn't want to process my I-485 until I have a new I-94.

HELP!

Then go to the border and get new TN, then file I-485. You are risking retrogression by waiting to file I-485.

hmm.. my TN comes doe in June of this year... When should I send in the form? I know they allow 100(or something) or so days after your application (for the grace period between mailing and getting). I just don't know how early I should get my application in.

I believe you can only submit an I-129 TN 4 months before expiry.

As long as you send the I-129 before current TN expires, you get 240 days of 'pending' status after expiry in order to wait for approval.

Most, though, end up getting a TN at the border if this process delays much more than aa few weeks after current TN expires, since you can't enter with the expired TN (even if your I-129 is pending).

PANIC OVER!

My I-129 was approved on January 18th; the Vermont 'backlog' is now down to a couple of weeks.

My immigration attorney is now preparing all the paperwork for my I-485 - and I am collecting certificates, signing forms, and writing checks for a total of $850.

As a followup, the I-129 has been changed and you can now file up to six months before the current I-94 expires. Also we have been getting TNs approved in a week or two sometimes but others take a couple months. We also still have some pending for several months. CIS seems to have forgotten the older cases and moved beyond them.
