Do I sell my house or rent it out to qualify as a Non-reside

Post by ktown »

I have a job in the states ,but my family is in Canada, so from reading the threads on this forum ,I have to pay taxes on both sides of the border.
We have a home and my wife will be coming over to stateside later, but we do not want to sell this house .This is because we are not sure about the move yet?
To become non -resident will renting out this property make me qualify?
Do I have to just rent it out or set up a company to deal with rental properties.

Having your wife join you in US, even without selling or renting the house, will make you a DEEMED NON-RESIDENT.

Renting out the house will make your FACTUAL NON-RESIDENT.

There is little difference between the two, do if you are unsure about staying in US, don't rent, yet.

The key however is that your spouse join you in US and you sepnd a great majority of your time there.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
