Additonal Medicare Tax Form 8959 - required for 1040NR?

Post by elgoog »

I am filing Form 1040NR and was using OLT.com for doing my taxes. When I input my W-2 numbers, it calculates some additional medicare tax automatically: https://www.irs.gov/instructions/i8959 because I meet one of the thresholds defined there. Is there a way to around this by using a treaty article?

Thank you.

I do not believe the treaty has any provision against this tax.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
