Married US citizen- tax confusion

Post by randi18 »

Hi there,
I have done research but am still confused exactly how I should do my taxes this year as it is my first year in the USA. I left Canada Sept 6, 2017 to marry a US citizen- and did not work in the US until January 2018.

1) What tax form do I file in Canada? My father will be doing my Canadian taxes and he does them by long hand, in the actual book. Should he just use the regular New Brunswick tax booklet?? Or is there a non- resident special form I need to print from online? I have seen deemed non-resident forms but Im still unsure what that means.

2) I know I must file taxes in the US. I assume I will file jointly with my husband and then fill out the 2555 form for my foreign income. Is there anything else I should know?

Thank you in advance for any help you can provide.

Adding to say I did not sell any property to move here and I don't have any RRSPs or anything. I left a Canadian bank account open as I have some Canadian credit card debt and a student loan I am still paying off and am using that account to pay them. I saw something about a departure tax so I am not sure what that entails.

When you leave Canada, that year you file a return for your province, with a departure date. It is time for you to come into the 21st century and use a software, like Ufile, which handles departure returns well.

For US, as you say, you will file a full year 1040 joint with your spouse, reporting all world income and taking credit for Cdn taxes, and/or exempting wages only using 2555.

So if I file my Canadian taxes myself, using ufile, it should be pretty straight forward what I need to do (ie what forms I need to fill out)? My dad doesn't even own a cell phone and says he likes doing taxes the "old fashioned way" so he definitely won't be stepping into this century any time soon!!

Thank you for your response!

It is too difficult to do exit tax return without software. Too many exceptions

doesn't 2555 require 330 days out side of USA?

That is one of the possible ways.

Im in the same boat as you, entered Sept 1st and married Sept 26th. :)
Unfortunately, all emigrants must do taxes by hand and mail in (also mentioned here). Went through Ufile because I was hopeful there may be an exception (and sick of looking at all the schedule pdfs), but sadly it gave me the same results:

"You cannot currently NETFILE the federal return. Please review the following reasons, and make corrections when possible. If an (*) appears at the end of an explanation below, it denotes a NETFILE exclusion (i.e. the return cannot be transmitted).

Your mailing address is outside of Canada. *

You are a non-resident or deemed resident, or you emigrated during the tax year. *"

As for paper filing, it looks like its best to use the regular tax package as it has a section for emigrants where you can enter the date you left Canada. If you feel otherwise there's an explanation page here.
You'll just have to write the state and ZIP onto the address section when you print it off (won't let you enter non-provinces/numbers). Im a little confounded by the provincial return and spousal entries, but Im hoping sifting through this forum will provide some enlightenment. It looks like you can enter all 0's for their SIN and enter their worldwide income without repercussion to your return, but I'm not entirely sureIve read they use it to calculate your GST credits etc, but that doesn't apply to non-residents).

From everything I've read you are spot on for the US return side though.
This whole process is hairpullingly annoying though.

There is difference between not being able to DO your taxes with software vs not being able to Netfile
You can certainly use all thefeatures of uglier and simply print out the result and send
