Can 1040NR taxpayer file State resident tax return ?

Post by nirvana_1959 »

Canadian Citizen worked in Indiana on TN-1 during the week (returning to Toronto for the weekend)

Had an apartment (paid rent, utilities, etc.) in Indiana

Only source of income is from the job in Indiana

Based on the state tax document it seems I can. I will have file MFS (has to be same as the filing status in 1040NR). However, I want to ensure that they will not come after my tax deferred accounts (or something else).

Thanks!

In fact, you MUST file some form of state tax return if you earned income in that state, or lived in that state. Doesn't matter if you filed 1040NR. Evemn if it is just to get back the tax that was withheld for the state.

Irt can be a NR return for that state.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
