Canadian working in the US on a TN Visa -Social Security Tax

Hi,

I am a Canadian who has been working in the US for the past 1.5 years. I have just come to learn that those on a TN are required to pay social security / medicare. However, as far as I can tell, my employer has not been deducting it.

1) Can you confirm if I do indeed need to pay this? Could there be another category that I am paying this under?
1b) If so, what is the best way to go about reporting this? Will they charge me a penalty/late fees if I self-report?
2) Unrelated: Currently, I have not declared myself a non-resident in Canada yet. If I go ahead and do so, will I have to pay any taxes there? I qualify in terms of days spent in the US clause etc.

1. Yes, as a TN employee, you MUST pay FICA (SS and Medicare)< and more importantly, so should your firm, as they are supposed to pay half. You should have 3 or for withholdings or your paystup: IRS tax, SS, Meicare, and state tax if applicable.

If your firm is not withholding you, they are being fraudulent and you should report it. I would aske the firm first.

2. You are non-resident from the day you left canada to work. Period. File your 2014 (or 2013 if you left then) as a departing EMIGRANT. you should not have paid any Cdn tax on your US income, and it should not have been reported in canada.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
