Canadian getting TN visa and 18year old son continue study

Hi,

I'm currently in the process of going through paperwork for getting TN visa and planning to start working end of August.

My wife and 2 kids will be moving with me to US and the third oldest son which is 18years old will be staying in Quebec,Canada to finish CEGEP and university. He will be living with my wife's parents, his grandparents.

From the tax point of view will he be considered as a dependent staying in Canada? Will I have to pay taxes in Canada for US income?

No, you will be considered a US tax resident. While your son is a dependant (even that woudl be debatable at his age) and *could* be considered a residential tie, your center of viatl interests is clearly going to be US the moment you and the rest of your family leave.

So, include in your prep to go down south a review of the Emigrnants guide, and make sure you inform all Cdn payors that you will be a US resident on Aug xx.

Scan this forum, you will find info on what you need to do before leaving in terms of RRSP TFSA RESPs etc, to avoid headaches once you are a US taxpayer.
