When becoming non-resident for emigrant of Canada in 2012

Post by CanadianFam2 »

Hi, we want to know when we are considered as non-resident for Canada in our situation. I read that Canadian are non resident at the latest date of their leaving of Canada or the date they become resident of the country they immigrate (in my case, USA).

We moved in the end of June 2012 from Canada to USA and we obtained TN and TD visa to work in USA at the same time. But we obtained 184 days in USA at only mid-December. Then, when do we become non-resident of Canada? At the date of the moving in June or exactly when we obtained 184 days in December? Then, if it's in December, will we have to pay taxes in Canada for the income in USA from July to mid-December? Because we moved from Quebec (Canada) to Massachusetts (USA) and we will prefer to be resident of USA (for tax purpose) but non-resident of Canada after we moved because there are more taxes in Quebec. Thank you.

I forgot to tell that we moved in July and now we have only one joint bank account empty , credit card empty in canada and passport Canadian, no house in Canada, no investment in Canada since the moving. We don't have any other ties in Canada . We closed all other ties but we still have temporary life insurance.

You left in June. That is your departure date. You bacame US residents on the day you moved. Not more complicated than that .
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
