Form 8854 question

Post by Taxpoor »

The 8854 form instructions specify:

File your initial Form 8854 as soon as
possible after the date you relinquish
U.S. citizenship or terminate your
long-term residence. You remain
subject to tax as a U.S. citizen or
resident until you both file your initial
Form 8854 and notify the appropriate
authorities of your expatriating act.

So...I expatriated In November of 2012, and relinquished my USC in December of 2012.

My understanding from questions on this forum is that I file a 1040 and 1040NR along with an 8854 by June 15th 2013 to the IRS and an additional one to Treasury Dept. in Philly.

Correct?

I have been reading this form instruction and it almost appears that I should send an 8854 form immediatly after relinquishment (?) or am I mis-reading the insturctions?

The portion of the instructions that you quoted is for expatriations between 2004 and 2008. This portion of the instructions does not apply to you.

I am not sure why I keep missing these little items....I find the IRS instruction format either confusing or my brain is not wired tp accept this information in there format.
