TN to H1B, what to file in Canada?

Post by krazykanuck »

So I've been wondering about this for a while:

I was a student in the US on an F1 visa until December 2011, when I got a TN visa. I started work in January 2012 and my employer is currently adjusting my status to a H1B. I live and work full time in the US.

My Canadian assets are very minimal: a TFSA and two bank accounts (only ~$2000 each). I have filed my Canadian tax return for 2011 like normal, I didn't note any departure.

I assume that I will file as a resident alien in the US for 2012, but I don't know what to file in Canada and also don't know if my TFSA complicates anything.

Any guidance would be appreciated! Thanks!

Oh forgot to mention, I am a Canadian citizen and permanent resident.

I searched around the forums, but didn't find anything particularly applicable to my situation.

You can;r be a Cdn citizen and permanent resident. You probably mean that you think you are a tax resident of canad (you are not, since you began TN jan 2012).

You need to file a departure return for 2012, and need to get rid of TFSA

I started work on January 3rd or something, but I actually got my visa and crossed into the US in mid December.

Since I already did my 2011 taxes, would it be more correct to file an amended return for 2011 or when I file for 2012, just claim my first day of work as my departure date?
