Hi!

I was referred to your forum for my question. So here it is ...



I've been reading all the tax related topics I can find and still haven't found one that answers whether I need to file US taxes or not.

I will be getting a TN Visa, as I will be working at the client's premises every two weeks for a few months, thus crossing the border frequently over a period of a few months.

I have no intentions of living in the US and will be staying in a hotel for a week at a time every two weeks that I am down there. I will be on the payroll of my employer, a Canadian company, not the client. I own a home, pay mortgage, and all that, so not a problem to show I reside in Canada.

I just need to know if I will have to fill out and file tax forms with the US and if so which ones.

You will report all income in Canada of course.

As to whether you will need to file for IRS will depend on how many days you are in US. You may have to file in the state you work in.

You will only know this 'retroactively' when totalling up the days. 183 days in any 365 day period triggers US tax for that period.

The state in which you work can establish its own rules on taxation on work performed in their state.

Any tax you pay in US will be credited on your Cdn return.
