It looks like my best option is to hire a new and experienced accountant who can re-file my 2010 returns.

you have been gone for over 2 yrs now, how can he say you are residents of Canada? Do teh right thing and file Amended Returns to clear this up as Nelson said even without this residency issue you have not reported to teh IRS your wifes income, so isn't this enough to want to make you file correctly you CND Accountant has no clue on teh US side and vise versa these guys only deal with domestic files at least they can file properly in each of tehir jurisdictions, no!

I didn't think this was allowed under TD status... ie. she can go there to work in Canada, but cannot work at home or a remote office in the USA.

This is an immigration question, that Im sure our poster would havechecked into.
basically, as long as the Cdn firm has no dealings in US, and neither the firm nor the worker is benefitting from being physically in US, then the work does not violate any status.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

The fact that this situation can be open to interpretation is freaky. The last thing we want to do is jeopardize our legal status in the US.

Which is why the next step for us is GC.

Definitely. I would be getting a legal opion fora US immg atty before Iset up a home offcie in US if I was in any of the follwing statuses: H1/H4, TN/TD, F1/F2, B1/B2.
