It would be hard to justify any other outcome. After all, if a US citizen delays in filing his 1040, but does file, he cannot be penalized if he owes no taxes.
the same principle shoud apply for all these reporting mechanisms as well.
One still has to file 1040 and the reports (i'm sure some were hoping that IRS would forgive filing if one had no US-source income), but without any tax owing, its crazy that any fines would be levied.
