My uncle american citizen passed away more than 2 years ago. My brother and I (canadians) are the beneficiaries of his IRA fund and the company is now workiing on splitting the fund into two separate accounts, but to do that we need to get IRS individual tax identification number. Until now we filed 3 times on the advise of the investment company and our laywer and we were refused because the wrong information we were receiving from them.
We start this process in november, its 6 months now and after 2 trips to Burlington to submit the forms and getting 3 refusal letters, we are really getting frustrated.
We need to know which reason to fill in the application"a-h" reasons on the W7 form. last time our lawyer called IRS and they advised them that "h" other (see instruction) exception #1 (d) see letter. and this was wrong too
We would really appreciate if we can get the proper advise how to fill W7 and what other forms we need to fill
Thanks

The problem appears to stem from the fact that you are not taking any income from this IRA.
Without taking income, IRS is finding it difficult to issue you an ITIN.
You might just consider each taking a nominal amount, and then requesting W-7 using the exemption that you listed: 1.d

1(d 0 should have been accepted in any event, because of the REPORTING requirement. Did you attach the letter from the investment firm stating that you need an ITIN for reporting purposes? That is absolutely required.
