Married Canadian Couple - one has dual citizenship

Post by kaj2 »

My husband and I are both Canadians living and working in Canada. My husband became a dual citizen (US) several years ago. Recently we were told that he might have to file a tax form in the US even though we don't live there or work there. Is this true? Is there a minimum or maximum income that is reportable?

Yes, all US citizens should file regardless of where they live.

The rule of thumb is back file 6 years. There should no tax owing, once you take into account exclusions, credits and exemptions, but -- unlike canada -- just because you owe nothing does not mean you don;t have to file.

I would not worrry about minimum incomes. Get these filed.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Thank you for your response - it was very enlightening.
What form do we use to file US Taxes and where do we get this form? Do I have to declare my income as the Canadian wife of a Dual Canadian/US Citizen?

Thanks again...

irs.gov has all the info you need.

Look at the publication for US citizens abroad. I believe it is IRS Publication 54.

You should probabaly get a pro to do 1 year and just go from that for the rest.
