Tax Refund one year work visa** complicated.

Post by tommymacker »

Hi,

I was wondering if anyone could give me some advice on my situation?
I had a one year work visa from Dec 2008 until Dec 2009 for Canada. My Canadian girlfriend fell pregnant in April 2009 and we got married in Vancouver in Nov 2009. I applied for an extension to my work permit in order to buy some time so I could apply for residency but was refused. I did not receive notice of this refusal until Feb 2010 where I was requested to leave Canada ASAP. I notified my employer and returned to Ireland with my wife and newborn. I have applied for residency through spousal sponsorship and I am waiting to return to Canada.

I would like to know if I am entitled to a tax refund on the taxes I paid whilst I was working in Canada on my one year work visa? I was working as a Mechanical Engineer with a very reputable company. Some of my friends have applied for tax returns in different employment and have received the majority of their taxes paid back. Does being married to a Canadian mean my situation is different?

Any help would be greatly appreciated. Thanks in Advance.

The income was earned in canada and thus you need to file a Cdn tax return to determine your Cdn taxation. What you get back depends on (a) what tdeductions you have and (b) how much tax you had withheld.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
