Determination of residency for Canadian tax purposes

Post by dthidri1 »

Hi:

My wife and I have lived in the US for 6 years now. We owned property here (which is now sold) and had an H1B visa. We are planning to move back to Canada in 3-6 months. The ONLY ties to Canada would be my membership with a professional organization in Canada and disability insurance through a Canadian insurance agency (both of which I had uninterrupted before my move and during my stay in the US). There seems to be inconsistency on this issue in determination of residency for Canadian taxation purposes. Some information states these two criteria might make my 6 years in the US taxable in Canada. Is this really true? It doesn't seem correct.

Thanks.

You were not Cdn resident. You wil not be considered resident for any of the 6 years.

The situations you must be referring to are for people who were not in a treaty country, and who were having significantly more ties than you held.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Thanks for the clarification. I must have been confusing it with other non-treaty countries.
