No, it telss them you had an RRSP last year, the yeear before, etc.

It is usually better to make the election to defer BEFORE telling them you have an RRSP. Otherwise they can deny your untimely election, and make you pay taxes on RRSP for the past 6 years.

2. There is no provision to back-file TD 90 forms. It has no impact except to alert them that you have not filed. It also tells them you had an unreported RRSP.

The only issue is they could decide to deny your election to defer RRSP taxation. since you did report income. Problem is you didn't report ALL RRSP income, so they could say that not only do you need to report the int/div for those years, but also the cap gains.

1. a w-8 or w-8ben should be on file.
2. Its not Cdn tax you are worried about, It's IRS tax. If none was witheld, good. the 1099 should noy have been issued, and certainly not reported on 1040.

You would need to reapply. The idea is that they want to know that you are clearly establishing Cdn residency, not simply staying 3 months and then leaving (OHIP is funded by your taxes after all).

They do that by insisting on 5 months full-time residency (they will still give you the card after 3).

When i say you are not taxble in US, I mean no tax is to be withheld from your RRSP by the broker.

Was IRS tax withheld from your RRSP?

You are NOT taxable in US on your RRSP. Period.

Those who have, have usualy been as a result of not filing a w-8 of some sort with the broker.

How could your accountant have advised you to file tese, and not told ...

For newly arrived immigrants, OHIP kicks in after 3 months (90 days). Leaving for more than 30 days in the first 6 months would get your OHIP pulled, not delay your enrollment.

Thereafter, as you say, it is a rolling 153 day requirement.

I suppose you could make the election for 2001.

Since RP 02-23 only came out in 2002, and since you did nothing for 25 years, what's the point.

The crucial year is 2003, where you must abide by Notice 2003-75, or be forced to file form 3520 for that year.
