but doesnt the 1040 NR also declare me as a non-resident of the US also?

it doesn't "declare" anything. It merely states tha tyou have not met the criterion requiring that you file 1040, not have you chosen to file 1040. 1040NR is typically unfavorable taxrate, so IRS doesn't mind.

It doesn't change thefact that you left Canada, and are meeting the treaty definition of residence in US. It's a transitional period.
