How does a departure return differ from a regular return?

Post by Fructose »

I moved from Canada to the US and so want to file a Canadian departure return.

I cannot find on the internet any form specifically for this (did I miss it?) so I presume a regular return form is used but certain lines within the form are filled in to indicate one's departure date etc.?

Read the CRA emigrant's guide.

Right. Please use software. Ufile online works great for departure returns. It is the same form as the one for your last province of residence with -- in a nutshell -- differs in these 4 basic ways:

1. You provide a departure date on front.
2. You report world income before that date and certain (but not all) Cdn income after that date.
3. You are deemd to have sold almost everything you had on departure date and determine cap gains accordingly, and
4. Certain credits are prorated based on your departure date, unless your world income after your departure date is minimal.

You are NOT a non-resident in your departure year. You are an Emigrant.

You do not need to submit an NR73 to make your own determination of residency or departure date.

I can no longer find a copy of it, but I am sure when I filed the 2011 return I said I had left and what date etc. The CRA wrote and asked me for more information, unfortunately I have lost their original letter and my reply, but it almost certainly involved dates of departure from Canada.

Going through my papers I have just found this Notice of assessment from them which says:
"... You have to pay withholding tax at source on investment or pension income or similar payments you received as a non-resident. We will send you a separate "Notice of Assessment" for the tax payable on this income.
You did not give us the information we recently requested within the time specified. As a result, we have disallowed your section 217 election.
We are holding your refund until we assess your non-resident tax."

Does this mean they have determined/classified me as a non-resident?

( I did send them the information they requested, maybe my letter and this crossed in the mail. Also I never received the other Notice Of Assessment they mention.)

Tip: no one cares more about your situation than you do.

I was going to hire Serbinski as my lawyers/accountants to sort this out for me, and initially paid the fee for the initial consolation with a view to expanding that to file non-resident withholding forms and tax returns etc.

But I've now got a refund and have gone elsewhere. The reason: your perpetual condescending, arrogant and patronizing attitude on multiple threads to multiple people.
If you're in any way associated with Serbinski then I don't want to give them my business. If you're just somebody who uses their forum, then it creates a bad impression of them anyway.
