When we can not apply for TN any more ?

If my company has applied for I-140, will it be a problem for issuing TN visa or once I-485 has been submitted, only then it presents as intent to immigrate and officer will deny TN visa

Please advise

While I-140 is an immigrant petition on your behalf (which is a question on the I-129 petition that one would have to answer 'yes' to) both CIS (for mail-ins) and CBP (for border petitions) are under instructions to NOT disallow TN applications simply on the basis of I-140 submission or approval.

The submission of an I-485 however IS universally considered irrefutable immig intent, preventing entry on, or approval of TN 9and a host of other non-immigrant statuses, except for H and L)
