Unsuccessful TN -> H4?

Can I apply for H4 status at the Port of Entry immediately after they rejected my TN application? (my husband is on H1-B) Will I raise too many red flag for them to consider as "misrepresentation"?

What misrepresentation? Since your husband is on H1, don't you already have H4? You should have applied for that as soon as he got h1.

Now, you are simply geting what you were already entitled too.

There is no problem.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Although - don't use the word "entitled" to the guys at the border. I don't think they view it the same way as regular folks.
