Transfer H1B to personal corporation (incoporate oneself)

Post by worryfreeinvestor »

I currently hold an H1B. I thought I had read, in this forum, that it is possible to establish a personal corporatation (C-corp?) in the U.S., hire myself, and transfer this H1B to the corporation I have established.

I can't find the posting that I recall.

Is what I've described possible? If so, what steps would I need to take next?

Thanks for any light you can throw on this!

I will say with certainty that Step 1 for you is to get in touch with an immigration lawyer for a consultation. I have a feeling that Step 2 will be that you go back to your H1 job and forget about this scheme. I'm not a lawyer, though, so my certainty is less than 100%. I highly doubt that you will be allowed to get away with this.

You cannot self-sponsor as an alien worker.

Cheers!
