TN --> GC through PERM for contractor - possible?
Hi, I am wondering - do you need to be a permanent employee on W2 in the company to start the GC process? Is there a way to go for GC remaining in a company as a contractor?
I'm pretty sure you can go thru the entire process while on 1099, however, the sponsorship must be for an EMPLOYMENT position, so the firm would have to proceed with the understanding that they would eventually be hiring you (ie. after you get your GC).
Remember that any EB gren card process is basedon FUTURE employment. You don't have to ever have worked for your sponsor, let alone be an employee througout the process. Bt, you and the firm are promising to get into an employee/employer relationship once your GC is approved.
