Applying for green card while living in Canada

Post by Adam_kheil »

Hi,
I am working remotely for a USA company from Canada( I do go to the US once or twice in a month). I am on H1 and company is willing to do my greencard application, question is can I still live in Canada and work remotely during this process or will I have to be physically present in the USA? I will choose AOS at a consulate in Canada. Even if I move to USA I will still be working remotely from home. Please suggest what will be the best course of action. Thanks

You can't choose AOS and then process at a consulate. This is called CP (consular processing). You can do this from outside US, but the expecation is that you move to US after getting green card if not before.
