PR conditions for my spouse

Post by usagirl »

Hello,

I have a question about meeting PR requirements.

I am a Canadian citizen currently living in the US on a H4 visa. My husband is working here on a H1 visa. Last year I sponsored him for PR in Canada and earlier this year he completed his landing formalities and then we returned to the US.

My question is, is it still possible for him to retain his PR while living with me out of Canada? Does the same rule of living for 2 years out of 5 in Canada apply to sponsored spouses too?

I am currently not employed and he is supporting me, so I was wondering if that might make a difference.

I would appreciate any advice on this. Thanks in advance!

In general, the time spent abroad with one's Cdn spouse is not counted against the three years outside Canada.
