US citizen and NRA in a Canadian partnership

Post by Jaden »

i am a US citizen my spouse is not; we both live in canada

recently our self employed income was put together as a partnership under canadian taxes…i think i have to reveal somehow that i am in a partnership

how should i file in the US? do i have to file married filing jointly using his status as RA or can i use married filing separately because he is a NRA…if so do i fill out schedule C only for my portion (25%) of the partnership? does his portion of the business need to end up on my taxes at all…i don't want to file in a way that will subject all of his portion to the US rules…or maybe i have to?…of course FTC may be applied so perhaps it will work out, but i am hoping to just file my portion…

my FBARs will reflect that i have signing authority on my spouse's bank account
