Deceased Mother Final Tax Return

Post by KevKiki286 »

Hi Folks,

So my mother came down to the USA in 2011 as a permanenet resident. Sadly, she passed away in September 2013. As her only surviving next of kin The Canadian government says to me "how about filing that final return for her champ? I live in Oregon. Dual citizen. So I sit down tonight to do the T4a they send me as the only income she had was her Canada Pension and Old Age Security.

Then I start wondering she lived all of 2012 and up to September 2013 in the USA as a permanent resident but had her only income from Canada. Just WHO do I do the final return for? The Canadian government as they are asking or the USA since she lived down here in Oregon since March 2011?

Thank you for your help. Appreciate it

Well, it looks like she forgeot to inform CRA that she left Canada in 2011! Otherwise she would not be getting T4s she would be getting NR forms. And her Cdn taxes would have already been taken care of. she owes no tax to Canada for OAS and CPP since the date she left Canada.

Unless she has other investments in Canada, she shouldn't have to file a final return. She shoukd have filed a departure return for 2011 and told SERVics Canada that she moved.

You need to go back to 2011 and fix this.

She should also have been filing in US all along too, reporting her world income to IRS.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
