Canadian working in US filing first Tax return

Post by ssobczak »

I'm a Canadian citizen and moved temporarily to the US to work for a US marketing firm as an intern in 06/13. I filed form 8233 to be exempt from all withholdings (my income was supposed to be <$10,000). I made a little more than this amount and now I need to file a US tax return.

Do I use form 1040NR and claim that I have not paid any taxes?

Am I exempt from any taxes?

I should also note that I am on a J-1 visa (I finished school in Canada however I came here in June for an internship). Do I still fill out form 8843?

You are not exempt for US taxation when you are J-1. and you made more than 10K.

So, yes, you need to file 1040NR and pay the tax, and then take credit for it on your CDn return (es, you are still taxable on world income in Canada)

8843 doesn't apply to you becaaue you can't meet SPT on J-1, so you don't need to worry about being considered US tax resident. You are not.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
