Aug 2012 is the first year we moved to US. My bf qualifies as filing as non resident, single, for 2012 return. He requested filing extention to Oct 15. After doing research, he wants to file as resident alien to take advantage of the standard deduction through form 2555. But now he just discovered that there is filing requirement for foreign accounts and he does have over $10000 in his canadian bank account which means he will need to file TD F 90-22.1 by Jun 30! Of course he didn't file this before Jun 30vbecause he is just doing his return now and didn't know this before. If he still chooses to file as resident alien and file TD F 90.221 now and explain everything to the government, will he be penalized? He didn't do this intentionally, and got filing extension so didn't check out the filing till now.
Or if he chooses to file as non resident, does he still need to file TDF 90.221?
