New to US. Filing taxes and so confused

Post by KJB »

I had Canadian income until July/12 and started collecting CPP disability pension in Aug/12. I left Ontario on Sept 26/12 and moved to California on a K1 visa. I got my green card in Feb/13. I have not worked or earned income in the US.

I know I need to file an exit return in Canada, but I cannot figure out the non-resident/deemed resident distinctions. I was in Canada for more than 183 days, but moved to a tax treaty country... ugh. Non-resident? Which option do I choose?

Do I report all of my income on my Canadian return, or only what I earned up until the departure date, and then report the rest (Cpp disability for Oct-Dec) on a US return?

Since my husband was not my husband until after I left Canada, and he was never a resident of Canada at all, do I need to include his income in my Canadian return?

I believe for the US tax return, I would file a 1040NR since I didn't have a green card in 2012 and don't pass the substantial presence test. Is that a correct assumption? Also, I've read about a 2555 to exempt Cdn earnings - would that apply to me also?

Sorry for all the questions, but I'll be ever grateful if someone can help me out.

You are non-resident from sept 26 2012, that is what you put on your Cdn DEPARTURE return. Read the Emigrants guide from CRA. You are coming to this very late in the tax year, so can't give you much morehelp than to look for the answers in other posts.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
