Deduct Canadian tax on 1040NR Schedule 1

Post by jhuang1213 »

Commuter GC living in Canada and working in US (company has offices on both sides). This year is the first time I need to pay Canadian tax on top of Health Premium due to mis-calculated RSP contribution in 2012.

Did I read some prior posts correctly - I can treat tax paid to Canada as "State and Local tax" on US return?

Follow-up questions if the answer is yes to the question above,

1. Do I need to use 8833 "non-discrimination" clause to claim this benefit?

2. Would it be trick to do this? First I need to figure out US tax first in order to calculate Canadian Foreign tax credit and canadian tax payable. But US tax itemized deduction depends on Canadian tax paid. How to resolve this dead-lock?

Thanks for helps of this forum over the years.

No. You cnnot decut Cdn tax on 1040NR. You were looking at a post that describes how to fill a 1040 to come up with a special tax rate to the napply to 1040NR.

Commuter GCs are not eligible to file 1040NR, because they have a GC.

To use the deduction on 1040, it has to be tax actaully paid in the calendar year, not the tax calculated on your tax return.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
