Qualifying for EITC

Post by triunbad »

I have a client whose spouse is not a US citizen. They are both Canadian residents. Can she file as single on her 1040 in order to qualify for the EITC, or must she file as MFS.

Should you be paying Mark for a response?

Married persons can only file MFS, or, if they meeet the criteria, Head of Household, but that would require living apart.

She would also not be allowed to use 2555 to exclude her wages.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
