Canadian independent contractor - US tax implications

Post by bcrier »

Based on some browsing I was able to determine:

- On TN you cannot be an independent contractor, you have to be on W2. Is this correct?

Some questions, if the contract length is under 12 months:

- Will I need to pay taxes in US and in Canada

- If I am an independent contractor in Canada, but working in US on a W2, can I claim my travel expenses against my incorporated business in Canada

- How can I be an independent contractor in US?

Thank you. Your help is appreciated.

You can indeed be a contractor (paid by 1099) on TN. Your client becomes your sponsor. Anything you read to the contrary is flay wrong.

If you are a W-2 employee, you cannot be considered self-employed in canada, since you will not be paying yourself.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
