need help for penalty of $2500 + int for late filing T2091

Post by zhangym »

I moved to US last year and sold my property in Canada right after I moved. I just got informed by CRA that I need to pay $2500 + interest penalty for filing T2091 form late.
I was not informed by my lawyer at the sale about this form... plus I only decided to stay in US permanently at the very end of last year.
Anybody has experience with that? Is it possible to get some kind of 'discount' on the penalty?
Thx in advance.

Go after your lawyer for the money. He should have informed you.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

This is why you need to consult with professional advisors who deal in cross border issues, the lawyer I am guessing does not deal in this area at all otherwise he would have informed you of the time limit and better still the seller would be liable for witholding tax of the Gross Sale Price had the certificate to reduce witholdings not been appiled for on time. Now that you filed your tax return to calculate the final tax owing they add onto this tax any penalty and interest owed for not complying on time.
