Inheritance

Post by Pamela »

My husband's brother passed away last week in Vancouver and his estate will be inherited by his siblings. What are the U.S. tax consequences of this to my husband? Question 2: An elderly Canadian parent's estate will eventually pass to her children - should she make changes to her will to ameliorate any tax consequences to my husband?

Pamela:

1. Since the estate will pay any tax before distribution, your husband should receive his share free of any tax (Cdn or US). He will though have to report the inheritence to the IRS if it is greater than US $100,000 on Form 3520.

2. Generally no.
