Taxes withheld after TN1 Visa expired

I have a client who had a TN1 Visa for a one year contract in the US. The contract ended in October 2008. The TN1 Visa was supposed to expire at the end of the contract. He had a new contract setup after that to work in Antarctica. The company that he was working for still withheld taxes and sent them to the IRS, even the though the TN1 Visa had expired. Can he still recover the taxes from the IRS? What forms will he need to file in order to get this money back.

Gettin back tax from IRS has NOTHING to do with his TN visa, file a 1040NR and claim the tax back
