Filing 8840's

We have several clients who we file 8840's here, as we have many retired clients who go to Arizona for the winter. Has anyone heard of anybody being penalized for not filing the form though they spent the winter down south?

8840's are only fpr a very narrow clientele:

Thos who meet SPT using the 3 year calculation, but do not stay 183 days in the calendar year.

If they fail to file 8840, they could be liable for tax on world income.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best

Thos who stay longer than 183 days in a calendar year, have to file a 1040NR and expalin that by treaty they are still Cdn residents.
