Corp to Corp remote work from Canada most of time

Post by Jonathan12342001 »

Hi,
I have searched the forum and like to reconfirm my understating for my situation. Appreciate any feedback and guidance.
I am working remotely from Canada through a US staffing company on a C2C contract as independent contractor and provide consulting service to a US client, might need to travel under TN to US occasionally for a week monthly. US staffing company wire the payment to my company’s bank account in US$ .
Most or all income will stay in my company this year and not pay to myself due to higher income and retirement allowance received this year from my previous employer in Canada.
Below is my understanding & questions –
1. I need to provide W8-BEN-E to staffing company (article VII, business profits) to avoid withholding tax. currently there is no withholding tax by US staffing firm.
2. I do not need to file US personal tax if I spent less than 183 days in any given 12 moths or doesn’t meet substantial presence test. Just personal and corporate tax in Canada.
3. I will not have 1099 from my staffing agency as well.
4. Do I still need to file form 8233 still?
5. Do I need to file 1120-F for my own company to IRS?

Thank you!

Remote Work from Canada to Company addresses important tax considerations for Canadians working as independent contractors for U.S. companies. I think the insights into corporate tax obligations and the lack of 1099 forms from staffing agencies provide valuable information for anyone navigating cross-border work arrangements.
