Working for a US company on TN/H1b remotely in Canada?

Post by dileepsv »

Hi wanted to ask if this is possible…

Plan:
- Work remotely for a US company
- Get TN-1 or H1B at the border and cross back to Canada
- Live in Toronto, Canada
- Give a US address (a friend’s) for the company’s W2/tax purposes
- Occasional travel 20% of the time to US/Canada/Europe locations

What would you guys say on the reality of this being possible? Would the employer even know that I am working in Canada?

You can, but why give a false address? If you are physically living in Canada, you should only use a Cdn address. And you should be paid on a Cdn payroll.

Your TN would only be used for occasional entry.

Right, but what if the employer is a startup or a smaller/mid size company with ZERO presence in Canada?

Its tough to get them to agree to pay through some third party - they'd rather find another employee who is a US citizen instead.

So just wanted to understand the specifics of how I could do this..

You would need to move to the US.
