Are Canadian Joint Bank Accounts Trusts for IRS 3520?

Post by Stevecanada »

My elderly father and I are both residents of Canada - he is a US citizen, I am a Canadian citizen. We have a joint Canadian bank account. With the new CRA reporting requirements on bare trusts, I understand that I may have to report my father's bank account to the CRA as a Bare Trust. It never occurred to me that a joint bank account could be considered a trust. My question: Would the existence of a Canadian joint bank account where an elderly parent has their child's name added to the account trigger the need to file IRS form 3520? Any help would be appreciated.

No. You would need to report it on FBAR, but it is not a trust by US standards.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
