Filing section 216 as a Canadian Emigrant (non-resident) for 2022

I emigrated out of Canada in Feb 2022. I do own rental properties in Canada, however I was ignorant, and didn't withhold nor remit 25% of my gross rental income for 2022. I started doing that for 2023.

So for 2022 tax returns, do I need to elect under section 216 and report my rental income and expenses for 11 months (Feb to Dec) of 2022? So that CRA can do the assessment and charge me with any taxes and penalties owed?

You really should file a 216. Otherwise, you will need to write a letter, informingh them of your rental GROSS income for the period after departure, and a cheque for 25% of the gross.

Hopefully you have also file an NR6 to determine a lower withholding rate for the rest of the year(s) you are non-resident.

@nelsonq - would you happen to know what should I be inputting as TOTAL INCOME (line 1 box 15000) in section 216 election form?

As I said, your 216 will account for only the period in 2022 after you left Canada.
