Canadian Citizen, married to US Citizen. I am a permanent resident in US and have a Green card.
I have been offered a job by my former Canadian Company, working from home in US 90% of my time and will work in Canada 10% of my time...approx.
Do I get paid in CAN dollars, just go on payroll with Canadian Company and have them deduct tax at source, OR, do I become self employed or Consultant, and have them pay me gross in US dollars.
I have spokenwith US Immigration, IRS and tax accountant and cant get the same answer twice!!
I am afraid that when I come back to US, the border could take my green card if they find out i am working in Canada....happened to a friend of mine, although Immigration said they couldnt....

First off, immigration has nothing to do with this.
Secoong, how you are paid has little to do wit the tax office, but is a choice between you and firm
However, if you are an employee, if you both live an work in the same place, you should be paid under the regime of that place, so your firm would HAVE TO set up a payroll in your state.
If you and they CHOOSE instead to be a contractor, then they can cut you a check every month for services rendered, and you pay your taxes (in US only).
The currency you get paid in doesn't matter.
What matters is if you are employee or not, and where you perform most of the work.

Canada does not base its taxation on citizenship. If you do not live and are not employed in canada (physically in canada), you do not pay any taxes in canada on that income.
