Moved to US in May on TN, do I file in CAN as non-resident?

Post by animalchin »

Hi,

I was overwhelmed by the search results and couldn't find my exact situation, sorry if this has been answered already.

I moved down to WA from BC in May of 2010 to work on a TN visa, I had a fulltime job in Canada and bank account interest so I have Canadian income for 2010, but most of my income is from May-Dec from my US employer while I was living in the US.

I think I meet the criteria for being taxed as a US resident, and have changed my Driver's license, cancelled my BC health insurance and imported my car, but I still hold several canadian bank/investment accounts and a credit card.

My expectation is that I need to file a 2010 return in Canada for all my Canadian sourced earnings, but since my departure was in May I don't need to file my US source income (since I'll file as a US resident for my US income since May).

Does this sound correct or will I potentially have to file as a resident of both countries?

You file your 2010 Cdn return as an EMIGRANT. Follow the emigrants guide from CRA.
After 20 years, I am severely cutting back on responses. Do not ask specifically for my help. There are a few others on this board that can answer most questions. All the best
